each case is one for the courts, and the parties to such trans- -actions must be left to take such action as they may be advised, provided of course that they do not bring themselves within the range of the criminal law.
An important point which will have to be considered by the parties to contracts which were in existence at the commence- -ment of the war is whether the proclamation of the 5th. August has made any alteration in the law of this Colony, as distinguish- -ed from that of the United Kingdom, with regard to the enforce- -ability of such contracts, as the powers of legislation possessed by His Majesty in respect of this Colony differ from those which he possesses with respect to the United Kingdom.

It must be remembered that the proclamation is declara- -tory and selective. In other words, it is only declaratory of such parts of the common law against trading with the enery as it is thought advis ble to enforce.

The prohibition of the common law is not against trad- -ing with enemy subjects but against trading with alien enemies, namely, with all persons, whether enemy subjects, neutrals or British subjects, who are resident on enemy territory. On the other hand the prohibition is against any such trading by any persons in the British dominions, so that even enemy subjects who are allowed to remain in the British dominions after the out- -break of war are debarred from trading with their own country just as British subjects are debarred from trading with the enemy
country.

An important distinction exists between contracts made during the war and contracts made before the war. of the former it can be asserted generally that they are prohibited. With regard to the latter various considerations arise according as the contracts are executory or executed, and according as they require to be acted upon during the war or not, and it is im- -possible to lay down any general rule as to their legality in distinction from their enforceability.
